 There are as many different ways of valuing a case as there are attorneys, insurance companies and armchair adjusters. Let me tell you about two very important ways of assigning value.

First is the insurance company’s way. You file a claim with the at-fault driver’s insurer, and they will offer you a sum of money in exchange for your agreeing to accept the amount in full settlement of your case and not bother them anymore. Often, the amount that they come up with is determined by a computer program designed to pay you as little as they can get away with.

The most unscrupulous insurance companies will even send you a tiny little check in the mail, often with a note saying they’re sorry you had a car accident and to “get yourself some massages to make you feel better.” On the back of the check is tiny print that, if you sign the check, says you have accepted the pittance as full settlement of your case.

Second is our way.
