It’s natural for people to hesitate about filing a claim, because you may think other people will look disapprovingly at you like it’s somehow a bad thing to bring a claim against them, or even sue them if need be. The insurance industry has done a good job of creating the false idea that people file a claims and lawsuits because they’re hoping to get a big settlement. They toss around the phrase “frivolous lawsuit” so much that people often think any claim is a frivolous action by a greedy person.

But if you’ve truly been hurt by someone else’s negligence, you should be fairly compensated for your medical bills, for your lost income and for your pain and suffering. I tell my clients this a lot: Almost no one gets involved in an “on purpose;” they get involved in an “accident.” That’s what insurance is for – to pay for the damages resulting from a Colorado personal injury accident.

People pay premiums so if they’re involved in an accident, the insurance company will compensate the injured party. It’s a business transaction – premium for protection. If you file a claim, or even a lawsuit, you’re filing an action that an insurance company is responsible for making good on. You should no more be intimidated or hesitant to file a personal injury claim than you should be to file a claim on your health insurance or your homeowners insurance.
