A judge in Santa Fe ruled that Allstate Insurance Co. engaged in what she called “malicious abuse” of the judicial process against four victims of car accidents. One of the attorneys for the victims said during the trial against Allstate that the insurer refused to offer a fair settlement for their injuries and instead forced the plaintiffs to go to court to get what they were entitled to. In her ruling against the insurance company, the judge said Allstate would force plaintiffs to sue as a way to “extort each of the plaintiffs into accepting less than the full value of their benefits…”
An Allstate spokesman said the company disagrees with the judge’s ruling.
Our Colorado auto accident attorneys see this type of behavior by insurance companies all the time. They’re happy to collect your premiums every month, but they’re not too interested in paying out money to settle claims. After all, that cuts into the old profit margin and executive bonuses. We won’t let them get away with that. Neither will the New Mexico judge. She said she intends to award enough money to the plaintiffs to punish Allstate and convince the company to not engage in bad conduct like that in the future.
