But in a significant number of motorcycle cases, the Denver motorcycle accident isn’t caused by a car hitting a cycle but by a “phantom” vehicle. That’s a car or truck that pulls out in front of the cycle rider, or a car that drifts across the centerline and into the motorcyclist’s lane, or an oncoming vehicle that turns in front of the motorcyclist. Then they’re gone, either because they’re not aware of what they’ve caused or because they’ve fled the scene.

The motorcyclist may not actually collide with the vehicle, but such an incident can cause serious injuries just the same. Often, the motorcyclist will lay down his or her bike to avoid what appears to be an imminent collision. There’s been a crash, there are injuries and the driver who caused the accident is nowhere to be found. Think of it as a hit-and-run driver, without getting hit.

In cases such as these, you can still be compensated for your injuries and the damage to your motorcycle by using your own uninsured motorist coverage. Your policy should provide coverage even though the other driver is long gone. In fact, this is an important reason why every motorcyclist should have good uninsured/underinsured coverage on their policy.

In my experience, insurance companies aren’t always eager to pay this kind of a claim, and may fight you – even though it’s your own insurer. That’s why it’s important to have The Law Offices of Dianne Sawaya working for you. We are very successful in convincing insurance companies that they need to take care of you, their own insured.

If your Colorado motorcycle accident was caused by a phantom vehicle, contact me today. We can help – and we don’t get paid until you get paid.
