If the accident causes particularly bad injuries, it’s not uncommon for you to be transported by ambulance to the emergency room for treatment, followed by care from your personal doctor and probably courses of physical therapy, chiropractic treatment and more. But if you receive medical treatment for several months followed by a gap of several months where you don’t have any treatment, and then you start treating again, insurance adjusters will argue that you recovered from your injuries and are just trying to increase the financial amount of your damages. At The Law Offices of Dianne Sawaya, we’ve seen adjusters and defense attorneys say you suffered another injury unrelated to the original accident and that’s what you’re being treated for.

The same is true when you have an accident and maybe see a doctor a couple of times but don’t receive medical care for several months after the accident. There may be perfectly good reasons you didn’t start treatment for awhile or have gaps in treatment. It can take a while for symptoms of your injuries to appear, or sometimes injuries seem to get better, but then take a turn for the worse. By the same token, some people may stop treating earlier than they should because they think they’re as better as they’re going to get, or because they don’t want to appear weak by continuing to go to a doctor for so long.

With gaps in treatment, adjusters will argue that you couldn’t have been hurt very badly – after all, you didn’t even get any medical treatment right away – and they’ll try to deny your claim or lowball a settlement offer. Be sure to get as much treatment as your doctor thinks is appropriate for your injuries.
