Four plaintiffs sued Allstate after taking their accident claims to trial when Allstate refused to pay a reasonable settlement. Instead the insurer offered them far less that what juries eventually awarded. The plaintiffs’ personal injury attorney argued in court in Santa Fe that the insurance company engaged in “predatory litigation tactics” to boost profits by keeping claims payments low. He said the company would offer “take it or leave it” payment offers. When claimants didn’t accept the payments, he told the judge that Allstate would force them to go to the trouble, time and expense of a trial to dispute Allstate’s lowball offers—in contrast to what he called the company’s famous “good hands” slogan.

The judge late last year agreed, and ruled that Allstate had violated the state’s Unfair Claims Practices Act. She ordered Allstate to pay actual, compensatory and punitive damages—punitive damages that she said were meant to deter Allstate from doing the same thing with other policy holders.

Not that it will stop them.
