The jury awarded $5 million for actual damages and $10 million for pain and suffering. The man who was the victim of the malpractice will see almost none of that money for his suffering.
A man in his mid-30s went to the Memorial emergency room complaining of severe neck pain and numbness in his arms and legs. The doctor who treated him said he had neck strain and sent him home.
A few hours later the man was paralyzed from the neck down. Seems it wasn’t neck strain after all, but a herniated disk that was compressing his spine, causing serious neurological damage and eventually leading to paralysis.
Colorado law says that this man, in the prime of his life, can collect no more than $300,000 for his pain and suffering. The tort reformers years ago managed to pass a law capping damage awards in Colorado to keep all those greedy golddiggers from trying to hit the malpractice jackpot.
Something tells me this man wasn’t looking for a jackpot. Not that it makes any difference to the tort reformers.
