The case was a rear-end accident with significant damages to the client’s auto on December 31, 2015.  The client, a 62-year-old female, initially had chiropractic care for neck and low back pain but eventually went to a primary care provider to get imaging and to a spine specialist 10 months later. The imaging showed degenerative issues and no acute trauma. The client continued to have neck issues and had no history of lower back or neck pain prior to the collision, despite the degenerative issues.

The client retired in September of 2018 and we maintained that this retirement was 3-5 years premature due to her physical limitations from the injury accident. The defense conceded that our client likely sustained a cervical and lumbar strain. At trial, we were able to put forth evidence through treating physicians that her degenerative issues made her more susceptible to these injuries and that this susceptibility was consistent with any person in that age range, as well as noting the absence of similar symptoms prior to the accident.

After a 4 day trial with a thoughtful and attentive jury, we received an award resulting in damages of over $200,000 after the Insurance Company had made a final offer of $31,000 just prior to trial.
